The lease expires as soon as you choose. Get the hell out of it.

I have to agree with Johnny here - as soon as you leave the better - but not if it affects you legally or you lose money.

Here are a few sites that may be interesting - though you probably already have them!! The last one is specifically for Victoria.

http://www.globalpropertyguide.com/Pacific/Australia/Landlord-and-Tenant

http://www.rentalagreementsdiy.com.au/tenancy_laws_in_australia.php

GOOD LUCK!!

((hugs)

Have rung the rent tribunal, the lease expires in late October and we can't get out of it or the agents can take us back to the tribunal for loss of rent, advertising and other costs. I wish it were as easy as saying we could just leave.

Oh, Kazzzz, that's terrible. Why should you have to suffer because of the misdemeanours of the landlord?

I don't understand. You are being threatened with eviction so does this mean they want to evict you before the lease expires? If you can stay until the lease expires at least it will give you 3 months or so to find somewhere else.

Well he's not paid his mortgage, but has bought some time, and is trying to remortgage the house (for the 3rd time). If we DON'T get eviced before October (which is still likely anyway) we have a current lease until the end of October. The problem is there aren't many rentals about here (because of the recent bushfires a lot of fire victims have taken them, fair enough too) and we also have to have a place that has room for a large towtruck, to compound the problem.
So we may have until October, we may not.
